1. Acceptance of Terms
By accessing or using the Fusion AI Gateway, APIs, CLI, or website (fusioncode.app), you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of an entity, you represent and warrant that you have authority to bind that entity.
2. Service Description & Availability
Fusion provides unified OpenAI-compatible API routing, inference acceleration, prompt caching, and token usage accounting for frontier AI models (including DeepSeek V4 Flash, MiniMax M2.7, and Kimi K2.6).
- Target Uptime: We aim for a 99.9% uptime across our global edge routing layer.
- Redundancy & Failover: Requests benefit from active-active cluster failover to maintain stream integrity.
- Maintenance: Routine maintenance is scheduled with minimal disruption; critical security patches may be applied immediately.
3. Billing, Token Accounting & Payments
Fusion bills for API usage on a per-token basis (covering fresh input tokens, cached input tokens, and completion output tokens) or via monthly subscription tiers:
- Metered Token Usage: Token counts are metered in real-time according to the rates published on our Models & Pricing page.
- Pay-As-You-Go Credits: Prepaid credit balances do not expire and are deducted as requests execute.
- Wholesale & Custom Contracts: Enterprise volume agreements and custom rate cards are invoiced in accordance with individual service orders.
4. Content Ownership & Intellectual Property
You own all rights, title, and interest in your Input and Output. Fusion claims no intellectual property rights or ownership over your code, prompts, embeddings, or generated model completions. You are solely responsible for ensuring your inputs do not violate applicable copyright or intellectual property laws.
5. Acceptable Use Policy
You agree not to use Fusion to:
- Generate illegal, harmful, or abusive content, including malicious malware or cyber-attack tools.
- Attempt to reverse engineer, disrupt, or launch denial-of-service attacks against Fusion gateway infrastructure.
- Circumvent rate limits, authentication keys, or billing quota controls.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Fusion and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the service.
